¿Aún no conoces las leyes de la logística? En este blog te presentamos 5 de las leyes más importantes que debes de saber sobre la logística en México.

Es bueno conocer las leyes básicas de la logística ya que con ello podrías evitar tener multas de comercio u otras consecuencias más graves.

Las 5 leyes importantes que tienes que saber en México son:

  • – La Ley de Comercio Exterior (LCE)
  • – Ley Aduanera (LA)
  • – La Ley de los impuestos generales de importación y exportación (LIGIE)
  • – Ley del impuesto al valor agregado (LIVA)
  • – Ley del impuesto especial sobre producción y servicios (LIEPS)

Ahora ya tenemos la lista de 5 de las leyes básicas de la logística y te platicaremos más a detalle en qué consiste cada una de estas leyes.

Comenzamos con la primera ley LCE. Sin importar lo que transporten o si son un agente aduanal, es esencial que conozcan la ley de comercio exterior. Esta ley regula y promueve el comercio exterior, ayuda a incorporar de una forma adecuada la economía mexicana con la economía internacional y contribuye al ascenso del bienestar de la población, entre otras cosas, es la legislación más importante para aquellos dedicados al comercio exterior.

Esta legislación comenzó en el año 1993, cuando se publicó por vez primera en el Diario Oficial de la Federación, se compone de nueve títulos en los cuales se expone el balance referente al comercio exterior en los Estados Unidos Mexicanos. 

En segundo lugar tenemos a LA o mejor conocida como Ley Aduanera. Dicho de una forma fácil de entender, esta ley regula el control de la exportación e importación de mercancía al territorio nacional,cobrar los impuestos correspondientes, así como también de los medios que lo transportan. 

Por otra parte está la ley número tres, (LIGIE). La función de esta ley es clasificar las tarifas establecidas en México para importar o exportar productos dentro y fuera del país. A estas tarifas se les conoce con el nombre de “arancelarias” y constan de 8 dígitos que van acompañados de notas explicativas y notas adicionales que permiten interpretar de una manera más sencilla las notas explicativas. 

Continuando con la cuarta ley de la lista (LIVA) o mejor conocido como IVA. Se encarga de regularizar las acciones que conforman al impuesto que se le cobra a las personas que adquieren o usan un bien o servicio. Y si hablamos dentro del comercio exterior, el IVA de importación es un impuesto que recae de forma indirecta sobre el consumo de productos.

Hay 2 situaciones catalogadas como las más comunes en las cuales es aplicado:

  • La Venta de Mercancías.
  • Importación de bienes.

Y por último pero no menos importante se encuentra (LIEPS). Esta ley se encarga de establecer las reglas para el impuesto pagado por importar y vender o producir y vender ciertos artículos.

A continuación te mostraremos algunos ejemplos de cada una de estas leyes.

En el caso de LCE, no hay distinción si eres un importador de productos textiles, o un especialista en transportes internacionales entre otras cosas, es primordial que conozcas las reglas de la Ley de Comercio Exterior para así poder  mantener a tu negocio en un nivel competitivo y libre de cualquier problema en especial legal.

Para LA te dejamos una lista de las principales funciones de una Aduana:

  • Inspeccionar la carga.
  • Revisar la mercancía que entra, sale o circula dentro del país.
  • Facilitar o prohibir la entrada o salida de mercancía dependiendo de su estado legal.
  • Solicitar información previa de las mercancías de importación o exportación.

En el caso de LIGIE anexamos el siguiente ejemplo: 

El capítulo 4 de la LIGIE, sobre “Leche y productos lácteos” incluye notas como:

En la subpartida 0405.10, el término mantequilla no comprende la mantequilla deshidratada ni la “ghee” (subpartida 0405.90).

Si te dedicas al comercio exterior, las clasificaciones arancelarias y las notas de la LIGIE son fundamentales porque de ellas depende cuántos impuestos pagarás y cómo debes pagarlos en aduana.

Si te equivocas en la clasificación de tus mercancías, por ejemplo, si clasificamos una mantequilla deshidratada con la subpartida 0405.10, incurrirás en un error que podría generarte multas o la necesidad de hacer una rectificación.

Ahora hablando de LIVA te damos un ejemplo de quienes sí y quienes no están sujetos a pagar este impuesto. Las operaciones que son de comercio internacional aplicadas por residentes mexicanos están sujetas al pago del IVA, con excepción por las maquiladoras, la industria terminal automotriz y los recintos fiscalizados estratégicos ( tal cual como lo mencionan en el artículo 9 de la LIVA).

Y como último ejemplo te dejamos una pequeña lista de los artículos donde aplicaría LIEPS:

  • Bebidas con contenido alcohólico.
  • Tabaco (Cigarros y Puros)
  • Gasolina
  • Diésel
  • Bebidas energizantes
  • Alimentos no básicos 

Estos son de los artículos más conocidos, en donde se aplica LIEPS.
